Fem Fitness Terms and Conditions of Use

Welcome to Fem Fitness. These Terms and Conditions of Use apply to and govern your use of our website and mobile application (the “Application”) and are intended to create a positive and law-abiding user community. By using Fem Fitness, you agree to all of the following terms and conditions.
Fem Fitness and any subsequent entities (collectively, “Fem Fitness” or “we”) provide various attributes and services through the Fem Fitness website and application (collectively, the “Service”).
These Terms contain a binding arbitration clause and class action immunity in Section 14. These provisions will affect your right to resolve disputes with Fem Fitness, so please read them carefully. By choosing to retain your account, access, or use the Service (whether or not you create an account on our Service), you agree to these Terms and our Privacy Policy (which is incorporated into these Terms). If you do not agree to any part of these Terms, please do not use our Service.
Please note that to help you better understand the attributes of these Terms, we have provided a summary in the shaded boxes above most sections. In the event of any conflict between this summary and any part of these Terms and Conditions, the Terms and Conditions shall prevail.

1. Using the Service and Your Account
1.1 Who Can Use the Service
You must be 18 years of age or older to use this Service (unless otherwise specified in the “International Terms” section of a particular jurisdiction). Individuals under the age of 18 may not use this Service, provide us with any personal data (as defined in the Privacy Policy), or otherwise submit personal data (such as name, address, phone number, or email address) through this Service.
1.2 Your Account
You must create a Fem Fitness account to access our Services, and your account information must be accurate and up-to-date (especially your email address – a valid email address is usually the only way we can verify your identity and assist you in logging back in if you forget your password).
You may need to register a Fem Fitness account to access or use certain services. Your account will also automatically provide you with instructions and access permissions for new services.
When you create an account for our services, you must provide us with accurate and complete information as prompted by the account creation and registration process, and keep that information up-to-date. Otherwise, some of our services may not function properly, and we may be unable to contact you to deliver important notifications.
You are responsible for maintaining the confidentiality of all actions taken while using your account. If you confirm or suspect that your account or password has been lost, stolen, or used without authorization, please notify our support team immediately. We are not responsible for any losses caused by unauthorized use of your username and password.
If you are an EU resident: You have the right to contact our support team to delete your account. If you choose to permanently delete your account, any non-public personal information associated with your account will also be deleted.
2. Attribute Ownership and Use
2.1 Definitions
"Attribute" refers to the attribute displayed within the application or on the website when you use our services. "User-generated attribute" refers to an attribute created by you or other users, while "Fem Fitness attribute" refers to all other attributes.
For the purposes of these Terms, (i) “Attribute” means any form of information, data, or creative expression that may be generated, provided, or otherwise accessed in or through the Service, including but not limited to video, audio, photographs, images, illustrations, animations, tools, text, ideas, communication attributes, replies, “likes,” comments, software, scripts, executable files, graphics, geographic data, training and conditioning data, biometric data and data elements derived therefrom, meal or fitness training plans, notes, nutritional information, recipes, interactive features, designs, copyrights, trademarks, trade marks, brands, logos and other similar assets, patents, audio, applications, and any intellectual property rights; (ii) “User-generated Attribute” means any attribute that a user provides to the Service, or submits, transfers, or otherwise makes available through the use of the Service; (iii) “Fem Fitness Attribute” means all non-user-generated attributes.
2.2 Ownership
You own all the attributes you create, and we own all the attributes we create. All Fem Fitness properties, and all copyrights, trademarks, design rights, patents, and other intellectual property rights (whether registered or not) in the Service, belong to Fem Fitness and/or its partners or applicable third parties. Each user retains all ownership, liability, and/or other applicable rights to the user-generated properties they create, and grants Fem Fitness the right to use such user-generated properties, as described in Section 2.5 below. Fem Fitness and/or its partners or third parties retain all ownership, liability, and/or other applicable rights to all Fem Fitness properties. Unless expressly stated in these Terms, you have no right or license to use any Fem Fitness property, including properties owned or controlled by our partners or other third parties. You agree not to copy, publish, display, distribute, modify, or create imitations or plagiarisms of the materials provided in the Service without our specific written authorization.
2.3 Our Authorization to You
We welcome your access to and use of Fem Fitness properties and services. We are committed to providing an excellent user experience, therefore please respect our intellectual property rights and use Fem Fitness properties and services only for their intended purpose. This includes the prohibition of using Fem Fitness properties or services for commercial purposes without our permission. We provide APIs and other tools for your use to assist you in creating your own applications and products. Please contact us for more information.
Subject to these Terms, we grant you a limited, revocable, personal, non-transferable, and non-exclusive right and license to access and use the Services and Fem Fitness properties for personal, non-commercial purposes, provided that you may not (and no third party may) copy, modify, create, reproduce, plagiarize, reverse engineer, sell, transfer, sublicense, grant security interests, transfer, or otherwise exploit any rights therein in the Fem Fitness properties or services for any commercial purpose.
3. Paid Subscriptions and Auto-Renewal Services
3.1 Paid Subscription Options
Fem Fitness offers the following auto-renewing subscription options (“Subscriptions”) and a one-time purchase option:
Monthly Membership: Subscription period is 1 month, price is HK$68.00/month.
Annual Membership: Subscription period is 1 year, price is HK$468.00/year.
Lifetime Membership: A one-time purchase priced at HK$368.00, not an auto-renewing subscription.
New users can enjoy a 7-day free trial (if offered). After the trial period, your subscription will automatically renew according to your selected plan unless you cancel in advance.
3.2 Auto-Renewal Rules
Your subscription will automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current subscription period. Renewal fees will be charged to your Apple ID account within 24 hours prior to the end of the current period. Subscription prices may be adjusted at any time, but any price changes will take effect in your next renewal period and you will be notified in advance via in-app notification or email.
3.3 How to Cancel Your Subscription
You can cancel your auto-renewal at any time on your iOS device by following these steps:
Open the Settings app;
Tap your Apple ID (profile picture);
Tap Subscriptions;
Select FEM subscription;
Tap Cancel Subscription.
After cancellation, your membership benefits will continue until the end of the current period, and you will not be charged again. Cancellation is not applicable to pre-paid current fees and no partial refunds are available.

3.4 Refund Policy
All subscription fees are collected directly by Apple. For refunds, please apply through Apple's official channels (e.g., visit reportaproblem.apple.com). FEM Fitness cannot process refunds directly. If you are charged twice due to technical issues, please contact our support team, and we will assist you in communicating with Apple.
3.5 Free Trial
The free trial period is only valid for new users. If you cancel your subscription during the trial period, no fees will be incurred; if you do not cancel before the end of the trial period, the system will automatically renew and charge you according to your selected subscription plan. 3.6 Health and Medical Disclaimer
3.6.1 Non Medical Devices: This application and all related services (including but not limited to AI generated dietary recommendations, exercise plans, and health data tracking and analysis) do not constitute medical devices and do not provide any form of medical advice, diagnosis, or treatment.
3.6.2 For reference only: The health and fitness information we provide is for reference only and should not be considered a substitute for professional medical advice. Before making any health-related decisions or regarding any medical issues, you should consult with qualified healthcare professionals.
3.6.3 Emergency situations: If you are facing or suspect that you are facing any potentially life-threatening emergency medical situation, please do not rely on this application and seek professional medical emergency services immediately.
