Privacy Policy

FEM Privacy Policy & Terms of Service Combined Version

Effective Date: March 31, 2026

This document combines the FEM Privacy Policy and Terms of Service, with supplementary provisions related to Health Connect data synchronization, UniPush push notifications and other services. By using the FEM Fitness App (hereinafter referred to as “the App”), you agree to all the following terms.

I. Privacy Policy

Disclaimer: This application is for fitness reference only and does not provide medical diagnosis, treatment, or professional medical advice. If you have any health problems, please consult a qualified healthcare provider.

1. Types of Data We Collect

1.1 Health & Fitness Data

● HealthKit Integration: Upon your voluntary authorization, the App may read your step count, active energy consumption (calories), workout duration, heart rate, sleep analysis and other data from Apple’s “Health” app. Such data will be used to generate personal fitness reports, AI diet‑tracking records, customized meal plans and workout plans.
● Health Connect Synchronization: If you enable Health Connect authorization, the App may access your step count, activity logs and other fitness data for cross‑device data synchronization and analysis.

1.2 Account & Usage Data

● When you register for or use the App, we may collect your email address, username, password hash (for account verification), device information (model, operating system version, unique device identifier), and app usage behavior data (page visits, function clicks, error logs) to optimize user experience.

1.3 Personal Information & Photos Uploaded by Users

● Users may voluntarily upload personal information to the App, including but not limited to body fat percentage, height, weight, before‑and‑after fitness photos, etc.
● All data uploaded by users (including photos, body fat percentage, weight records, etc.) shall be deemed as your consent for FEM Fitness to use such data on platforms outside the App, including but not limited to social media platforms (such as Instagram, Facebook, YouTube) for marketing, promotion, case sharing or other commercial purposes.
● FEM Fitness reserves the right to use photos or other data uploaded by users on the App as materials for social media platforms without prior notice or additional consent from users.
● You acknowledge and agree that all uploaded data may be publicly displayed, edited, cropped or combined with other content. FEM Fitness shall not pay any fees or compensation to users for such usage.
● If you do not wish your data to be used on social media or other public platforms, please do not upload such data to the App, or submit a written request to FEM Fitness before use.

1.4 Payment & Subscription Data

● Paid features of the App (monthly/annual subscriptions, lifetime membership) are processed via Apple In‑App Purchase (IAP). We do not directly collect or store your credit card number, bank account or other sensitive payment information. All payment processes are handled by Apple.
● We only receive non‑sensitive transaction information such as transaction identifiers, subscription status and validity periods from Apple to verify your membership eligibility and provide corresponding services.

1.5 Push Notification Data

● The App integrates the UniPush push notification service to send workout reminders, membership notifications and other messages. We may collect device identifiers and push tags to deliver targeted notifications. You may turn off push notifications in your system settings at any time.

2. How We Use Data

● Provide core services: customized workout plans, AI diet recommendations, exercise record analysis, cross‑device data synchronization.
● Improve user experience: analyze usage behavior, fix bugs and optimize functional design.
● Membership management: verify subscription/lifetime membership eligibility, process renewals, upgrades and refund requests.
● Push notifications: send workout reminders and membership alerts (can be disabled anytime).
● Marketing & Promotion: use user‑uploaded data (including photos, body fat percentage, weight records, etc.) as marketing materials for social media and other public platforms.
● Legal Compliance: respond to regulatory requirements and prevent fraud and abuse.

3. Data Sharing & Disclosure

We will not sell, rent or share your personal data with any third party, except in the following cases:
● With your explicit consent;
● To authorized service partners (such as cloud service providers, analytics providers, push service providers) who comply with strict privacy protection standards;
● When user‑uploaded data is used on social media and other public platforms (as stated in Section 1.3);
● When required by law or governmental authorities.

4. User Rights

You may at any time:
● Revoke HealthKit authorization in iOS Settings → Privacy & Security → Health;
● Cancel data synchronization authorization for the App in Google Fit settings;
● Delete your account and associated personal data in the App’s Account Settings;
● Contact us to inquire, correct or delete your personal data held by us.
Please note: If your uploaded data has been published on social media platforms (such as posts or videos), FEM Fitness may not be able to completely remove your data from such platforms.

5. Data Security

● We protect your data using industry‑standard encryption technologies such as HTTPS and encrypted data storage.
● Only authorized personnel have access to sensitive data with strictly restricted permissions.
● Although we take reasonable measures to protect your data, absolute security cannot be guaranteed due to inherent risks of the internet environment.

6. Children’s Privacy

● The App is not designed for children under the age of 13.
● If we discover that we have collected children’s data without parental consent, we will delete such data immediately.

7. Policy Updates

● We may update this Privacy Policy from time to time, with the latest version posted on this page.
● For major changes, we will notify you via in‑app notifications or email.

II. Terms of Service

1. Service Access & Your Account

1.1 Eligibility to Use the Service

● You must be at least 18 years of age to use this service (unless otherwise specified by applicable jurisdictions). Individuals under 18 shall not use this service or provide any personal information to us.

1.2 Your Account

● You must create a FEM account to access our services, and your account information must be accurate and up‑to‑date (especially your email address).
● You are responsible for keeping all activities under your account confidential. Immediately notify our support team if your account or password is lost, stolen or used without authorization.
● If you are a resident of the European Union: you have the right to contact our support team to delete your account. If you choose to permanently delete your account, non‑public personal information associated with your account will also be deleted.
● Please note: Even if you delete your account, FEM Fitness may not be able to remove your data from social media platforms if previously uploaded.

2. Content Ownership & Usage

2.1 Definitions

● Content: All materials displayed within the App or on our website when you use our services, including videos, audio, photos, text, training data, biometric identification data, etc.
● User‑Generated Content: Content created by you or other users, including but not limited to personal information, body fat percentage, height, weight, before‑and‑after fitness photos uploaded by users.
● FEM Content: All non‑user‑generated content.

2.2 Ownership

● You own all rights to the content you create, and we own all rights to the content we create.
● All FEM Content, along with all copyrights, trademarks, design rights, patents and other intellectual property rights (whether registered or not) in the service, belong to FEM Fitness and/or its partners or applicable third parties.
● You grant FEM Fitness a worldwide, perpetual, irrevocable, royalty‑free, sub‑licensable license to use, reproduce, modify, adapt, publish, translate, distribute and publicly display your User‑Generated Content uploaded to the App (including but not limited to photos, body fat percentage, weight records, etc.) for any purpose, including but not limited to social media marketing, promotional materials, case sharing and other commercial uses.
● You acknowledge and agree that FEM Fitness may use photos or other data uploaded by you on the App as materials for social media platforms without prior notice or additional consent from you.

2.3 License Granted to You

● Subject to these Terms, we grant you a limited, revocable, personal, non‑transferable and non‑exclusive right and license to access and use the Service and FEM Content for personal non‑commercial purposes. You shall not (and shall not allow any third party to) copy, modify, reverse‑engineer, sell, transfer or commercially exploit any rights in the FEM Content or Service.

3. Dispute Resolution

These Terms contain binding arbitration provisions and a class‑action waiver. These provisions affect your rights to resolve disputes with FEM Fitness, so please read them carefully.
By retaining your account, accessing or using the Service, you agree to these Terms and our Privacy Policy. If you disagree with any part of these Terms, please do not use our Service.
